NY L89910 February 3, 2006 CLA-2-61:RR:NC:TA:359 L89910 CATEGORY: Classification TARIFF NO.: 6110.30.3059 Mr. Peter Weinrauch Import Commodity Group Ltd. 131 East Merrick Road, 2nd FL Valley Stream, NY 11580 RE: The tariff classification of a woman’s pullover from China Dear Mr. Weinrauch: In your letter dated January 23, 2005, on behalf of Mometrends, Inc., 530 7th Avenue, New York, NY, you requested a classification ruling. Your sample is being returned as requested. The submitted sample, style number E64331, is a woman’s layered pullover that is constructed from 76% viscose, 24% nylon knit fabric (outer layer) and 78% silk, 22% spandex knit fabric (inner layer lining). The outer surface of both layers of the garment measures more than 18 stitches per 2 centimeters in the direction that the stitches were formed. The inner layer is sewn to the outer layer at the sideseams. The garment features a V-neckline and cap sleeves with ribbed edges. The outer layer has a straight bottom. The inner layer has a rib edged bottom. The front of the garment has embroidered designs. The applicable subheading for the pullover will be 6110.30.3059, Harmonized Tariff Schedule of the United States (HTSUS), which provides for pullovers, knitted: of manmade fibers: other…other: women’s: other. The duty rate will be 32% ad valorem. Duty rates are provided for your convenience and are subject to change.
