NY L89611 December 29, 2005 CLA-2-71:RR:NC:SP:233 L89611 CATEGORY: Classification TARIFF NO.: 7117.19.9000 Ms. Melissa Fox Barthco Trade Consultants The Navy Yard 5101 South Broad Street Philadelphia, PA 19112-1404 RE: The tariff classification of a necklace from China. Dear Ms. Fox: In your letter dated December 20, 2005, on behalf of Victoria & Co., Ltd., you requested a tariff classification ruling. The submitted sample is a 18” ladies necklace, identified as Style 811305710. It is made of non-precious metal and features three black plastic beads and a lobster claw clasp. The metal and the plastic beads used to construct the necklace form a composite good. When the essential character of a composite good can be determined, the whole product is classified as if it consisted only of the part that imparts the essential character to the composite good. In this case, the metal imparts the essential character to the good.       Your sample is being returned as requested. The applicable subheading for the necklace, Style 811305710, will be 7117.19.9000, Harmonized Tariff Schedule of the United States (HTSUSA), which provides for “Imitation jewelry: Of base metal, whether or not plated with precious metal: Other: Other: Other.” The rate of duty will be 11% ad valorem. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUSA and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
