NY L89013 December 2, 2005 CLA-2-83:RR:NC:N1:121 L89013 CATEGORY: Classification TARIFF NO.: 8306.29.0000 Mr. Joseph Stinson Liss Global, Inc. 7746 Dungan Road Philadelphia, PA 19111 RE: The tariff classification of a hanging ornament from China Dear Mr. Stinson: In your letter, dated November 8, 2005, you requested a tariff classification ruling. The samples you provided are two hanging ornaments made of metal wire and glass; one has a copper finish, the other a chrome finish. You describe them in your letter as “metal spiral spinners.” Both items have the same manufacturer item number (C26Z0905-1052) and importer item number (943716). Each measures approximately 14 inches long and consists of a 2-½ inch wire hook, a 9-inch twisted, wire spiral that spins, several wire-wrapped glass balls and a small, wire-wrapped glass figure. When it moves, the metal spiral component of the product creates a unique visual effect. The metal spiral is the predominant decorative feature of this item and, therefore confers its essential character. The applicable subheading for the base metal hanging ornament will be 8306.29.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for bells, gongs and the like, nonelectric, of base metal; statuettes and other ornaments, of base metal…statuettes and other ornaments, and parts thereof, other.
