NY L89009 December 8, 2005 CLA-2-63:RR:NC:N3:351 L89009 CATEGORY: Classification TARIFF NO.: 6307.90.9889 Robert Pfriender Allied International Development, Ltd. 3 Steuben Drive Jericho, NY 11753 RE: The tariff classification of a respirator facemask from Taiwan Dear Mr. Pfriender: In your letter dated November 21, 2005, you requested a tariff classification ruling. The submitted sample is a facemask that is identified as a “Disposable Particulate Respirator.” The mask is made of non-woven synthetic fiber with elastic straps. It measures approximately 7”W x 7”H. The two straps, which fit around the head, measure approximately 9”. You state that the principal use of the mask is for protection of healthcare workers, law enforcement personnel, first responders, and other persons against Avian Influenza, bacteria, etc. The applicable subheading for the “Disposable Particulate Respirator” will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUSA), which provides for other made up textile articles, other. The rate of duty will be 7 percent ad valorem. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
