NY L88876 December 8, 2005 CLA-2-62:RR:NC:N3:360 L88876 CATEGORY: Classification TARIFF NO.: 6208.22.0000 Ms. Stephanie De Silva Avon Products, Inc. 1251 Avenue of the Americas New York, NY 10020 RE: The tariff classification of women’s sleepwear from Macau Dear Ms. De Silva: In your letter dated November 17, 2005, you requested a classification ruling. The submitted sample will be returned to you as requested. Item PP 1031222 is a woman’s lingerie-styled pajama set constructed from 100 percent polyester woven fabric. The pajama top is a camisole that features a shaped front neckline, adjustable shoulder straps and a partial side opening secured by four button and loop closures. The bodice and straps are embellished with lace. The front neckline is also embellished with scattered beading. The tap pant features a partially elasticized waist with a self-fabric bow, a side opening secured by three button and loop closure and short legs with side vents. The legs are trimmed with lace. The applicable subheading for item PP 1031222 will be 6208.22.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ singlets and other undershirts, slips, petticoats, briefs, panties, nightdresses, pajamas, negligees, bathrobes, dressing gowns and similar articles: nightdresses and pajamas: of man-made fibers. The duty rate will be 16 percent ad valorem. Duty rates are provided for your convenience and are subject to change.
