Shira Sharretts, Paley, Carter & Blauvelt, P.C. 75 Broad Street New York, NY 10004 RE: The tariff classification of women’s jackets from China and India Dear Ms. Shira: In your letter dated October 25, 2005, on behalf of United Retail Inc., you requested a classification ruling. The samples submitted with your request will be returned as requested. Style 351196 is a women’s long sleeved jacket made of 55% silk and 45% cotton woven fabric which is quilted in a diamond pattern to a thin batting material. The jacket is fully lined, consists of seven panels, and features a mandarin collar, two front inset side-seam pockets at the waist, a straight hemmed bottom, and a full front opening secured by five hidden magnetic closures. Style 2240 is a women’s long sleeved jacket made of 100% silk woven fabric which is quilted in a stripe pattern to both a thin batting material and its full lining. The jacket consists of seven panels, and features a mandarin collar, two front pockets at the waist, a straight hemmed bottom, and a full front opening secured by five snap closures. The applicable subheading for style 351196 will be 6204.39.8060, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ suits…suit-type jackets and blazers: of other textile materials: other: other: other: other. The duty rate will be 6.3 percent ad valorem. The applicable subheading for style 2240 will be 6204.39.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ suits…suit-type jackets and blazers: of other textile materials: other: containing 70 percent or more by weight of silk or silk waste. The duty rate will be 1 percent ad valorem. Style 351196 falls within textile category designation 835. Style 2240 falls within textile category designation 735.
