Powers Lane Aurora, CO 80015 RE: The tariff classification of novelty hats from China. Dear Mr. Williams: In your letter dated October 20, 2005 you requested a classification ruling. The samples will be returned to you as requested. Six samples of hats were submitted with your request. Style 15103, Vampire Top Hat is composed of knit 100% polyester fabric. The hat has a 3” brim and a high crown with a hatband. Style 15098, Gothic Top Hat is composed of knit velveteen 100% polyester fabric. The hat has 3” brim, 6” high crown and a velveteen hatband. Style 15097, Zebra Pimp Hat is composed of knit velveteen 100% polyester fabric. The zebra print hat has a 4 ½” brim. Style 15093, Pimp Hat is identical in style and fabric content to style 15097 but with solid color fabric. Style 15096, Uncle Sam Hat is composed of knit 100% polyester fabric. The hat has a 7” crown, 2” brim and features red and white stripes with a blue and white stars headband. Style 15102, Deluxe Pirate Hat is composed of knit 100% polyester fabric. The hat has fabric attached at the back that extends down the back and elastic on the inside to facilitate hold the hat in place. The applicable subheading for Styles 15103, 15098, 15097, 15093,15096 and 15102 will be 6505.90.6090, Harmonized Tariff Schedule of the United States (HTS), which provides for “Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric…Other: Of man-made fibers: Knitted or crocheted or made up from knitted or crocheted fabric: not in part of braid, other: other: other The duty rate will be 20 cents per kilogram plus 7% ad valorem. The textile category is 659. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
