Dear Ms. Keller: In your letter dated September 22, 2005, on behalf of Orion Holdings, you requested a classification ruling. As requested, the sample will be returned to you. The submitted sample is a Style OSS79 Worker Vest. The unisex pullover garment is constructed of a bright yellow knit mesh polyester fabric. The sleeveless garment reaches to approximately 7-9 inches below the waist and features a V-neck, oversize armholes, and 2-inch wide 3M Scotchlite™ reflective silver strips horizontally around the waist and vertically from each shoulder on the front and back. The Style OSS79 Worker Vest is not worn for decency or adornment; it is an accessory worn as a safety identifier that warns oncoming traffic and others of the presence of the wearer. The applicable subheading for the Style OSS79 Worker Vest will be 6117.80.9540, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up clothing accessories, knitted or crocheted…other accessories: other: other, of man-made fibers: other. The duty rate will be 14.6 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
