NY L87209 November 8, 2005 CLA-2-61:RR:NC:WA:361 NY L87209 CATEGORY: Classification TARIFF NO.: 6110.30.3055 Ms. Sonja Chapman, Import Department Global Gold Inc. 1410 Broadway, 8th Floor New York, NY 10018 RE: The tariff classification of a woman’s upper body garment from China. Dear Ms. Chapman: In your letter dated October 7, 2005, you requested a classification ruling for a woman’s knit upper body garment from China. The submitted sample will be returned to you, as requested. Style JK55967-0016G is a woman’s upper body garment constructed from 55 percent polyester, 45 percent cotton knit fabric that has more than nine stitches per two centimeters in the direction in which the stitches were formed. The sleeveless garment reaches the waist and has a partial front opening with no closure, and a plain, hemmed bottom. The two front panels are twisted and attached at the bottom through two button-hole type openings, giving the appearance of two ties knotted at the bottom. The two front panels provide sufficient front coverage. The applicable subheading for style JK55967-0016G will be 6110.30.3055, Harmonized Tariff Schedule of the United States (HTS), which provides for pullovers…and similar articles, knitted or crocheted: Of man-made fibers: Other: Women’s or girls’. The duty rate will be 32% ad valorem. Style JK55967-0016G falls within textile category designation 639.
