Hawthorne & Co., Inc. 9370 Wallisville Road Houston, TX 77013 RE: The tariff classification of five women’s knit garments from Bangladesh Dear Ms. Girod: In your letter dated August 1, 2005, on behalf of Teams Solutions, 20503 Somersethill Court, Richmond, Texas 77469, you requested a tariff classification ruling. You submitted five samples of women’s knit garments. The outer surface of the garments measures more than 9 stitches per 2 centimeters in the horizontal direction. Style TS-042 is a sleeveless top that is constructed from 95% cotton, 5% spandex, knit fabric. The garment features a square neckline, a straight back, ¼ inch wide shoulder straps, a shelf bra, and a hemmed bottom. Style C-151 is a sleeveless tank top that is constructed from 100% cotton, rib knit fabric. The garment features a U-neckline, ½ inch wide shoulder straps, and a hemmed bottom. A jeweled design is on the front chest. Style 3111060 is a sleeveless pullover that is constructed from 96% cotton, 4% spandex, double knit fabric. The garment features a round neckline and a hemmed bottom. The neckline and armholes are finished with knit capping. Style TS-006 is a pullover that is constructed from 95% cotton, 5% spandex, knit fabric. The garment features a V-neckline, short hemmed sleeves, a left chest pocket, and a hemmed bottom. Style TS-004 is a pullover that is constructed from 100% cotton, knit fabric. The garment features a turn down collar, a V-neckline, short hemmed sleeves, a left chest pocket, and a hemmed bottom. Piping finishes the collar, the sleeves, and the neckline. The applicable subheading for style TS-042, the top, will be 6114.20.0010, Tariff Schedule of the United States (HTS), which provides for other garments, knitted: of cotton: tops: women’s. The rate of duty will be 10.8% ad valorem. The subheading for style C-151, the tank top, will be 6109.10.0060, HTS, which provides for tank tops, knitted: of cotton: women’s. The rate of duty will be 16.5% ad valorem. The subheading for styles 3111060, TS-006, and TS-004, the pullovers, will be 6110.20.2075, which provides for pullovers, knitted: of cotton: other…other: women’s. The rate of duty will be 16.5% ad valorem. Each of the five garments falls within textile category designation 339.
