One Bowerman Drive Beaverton, OR 97005 RE: The tariff classification of a men’s knit jacket from Malaysia. Dear Ms. Dykeman: In your letter dated July 18, 2005, you requested a tariff classification ruling. As requested, your sample will be returned. Style 198393 “MJ Uptown Sweater” is a men’s jacket constructed from two different knit fabrics. The garment features a zip off hood; a full front opening with a zip through mock neck; long, raglan sleeves with rib knit cuffs; slant pockets below the waist; and a rib knit bottom. The back panel, the raglan sleeves and the hood are constructed from 80% cotton, 20% polyester, finely knit fabric that is napped on the inside surface. The front panels are constructed from 70% acrylic, 30% wool, jersey and reverse jersey knit fabric that measures 9 stitches per two centimeters counted in the horizontal direction. The back panel and the raglan sleeves comprise over 60% of the visible surface area and impart the essential character to the garment. Consequently, the applicable subheading for Style 198393 will be 6101.20.0010, Harmonized Tariff Schedule of the United States, (HTS), which provides for: men’s or boys’ overcoats, carcoats, capes, cloaks, anoraks (including ski-jackets), windbreakers, and similar articles, knitted or crocheted: other than those of heading 6103: of cotton: men’s. The rate of duty is 15.9% ad valorem. Style 198393 falls within textile category designation 334.
