Dear Ms. Chen: In your letter dated July 1, 2005, you requested a classification ruling for a woman’s knit garment from China. The submitted upper body garment, style 4839ZGY5, which you refer to as a shrug, is constructed from 55 percent ramie, 45 percent rayon crocheted and knit fabric, decorated with sequins. The garment extends almost to the waist in back, has capped sleeves, and minimal front coverage. The applicable subheading for the garment will be 6114.90.9070, Harmonized Tariff Schedule of the United States (HTS), which provides for Other garments, knitted or crocheted: Of other textile materials: Other. The duty rate will be 5.6% ad valorem. The garment falls within textile category designation 859.
