Hoffacker Barthco Trade Consultants The Navy Yard 5101 South Broad Street Philadelphia, PA 19112-1404 RE: The tariff classification of a women’s hooded cardigan from China Dear Mr. Hoffacker: In your letter dated June 27, 2005, you requested a classification ruling on behalf of Broder Brothers DBA Alpha Shirt Company. A sample of style DP405W, a woman’s hooded garment, was submitted and will be returned as you have requested. The garment is made of 80% cotton and 20% polyester knit velour fabric. The outer surface of the fabric measures more than 9 stitches per two centimeters measured in the direction in which the stitches were formed. The garment features a full front zippered opening, long sleeves with rib knit cuffs, front kangaroo pockets, a hood with a drawstring and a rib knit bottom band around the waist. This rib knit band does not provide tightening at the waist. The applicable subheading for style DP405W will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters pullovers…and similar articles, knitted or crocheted: Of cotton: Other: Other: Women’s or girls’. The duty rate will be 16.5% ad valorem. Style DP405W falls within textile category designation 339.
