Box 422165 Del Rio, TX 78842-2165 RE: The tariff classification of a safety vest from Mexico. Dear Mr. Pohler: In your letter dated June 1, 2005, on behalf of RPS Manufacturing Solutions, Inc., you requested a classification ruling. As requested, the sample will be returned to you. You have submitted a safety vest used by the railroad industry. The vest is comprised of two parts, which connect at the shoulder by means of hook and loop fasteners. The vest is connected around the waist by straps and snaps. The materials forming the two parts are constructed of woven 100% nylon fabric. The item features a front zippered pouch. There are aluminum stays in the front and rear parts of the vest for added stability. You also asked for advice on classification if the vest was imported without the aluminum stays. The classification would be the same in either fabrication. The applicable subheading for the safety vest will be 6217.10.9530, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up clothing accessories; parts of garments or of clothing accessories; other than those of heading 6212: accessories: other: other, of man-made fibers. The duty rate will be 14.6 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
