NY L85245 June 7, 2005 CLA-2-61:RR:NC:TA:359 L85245 CATEGORY: Classification TARIFF NO.: 6104.31.0000 Ms. Jada Evans May Merchandising Company 615 Olive Street St. Louis, Missouri 63101 RE: The tariff classification of a woman’s suit-type jacket from China Dear Ms. Evans: In your letter dated May 24, 2005, you requested a tariff classification ruling. Your sample is being returned as requested. The submitted sample, style number 8998, is a woman’s tailored suit-type jacket that is constructed from 100% wool, cable knit fabric. The garment consists of three panels, two of which are in front. The three panels are sewn together lengthwise. The jacket features a notched-lapel collar, long sleeves with three button closures at the wrist, a full front opening with a two-button closure, a left chest pocket, two front patch pockets at the waist, and a hemmed bottom. The applicable subheading for the suit-type jacket will be 6104.31.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s suit-type jackets, knitted: of wool or fine animal hair. The rate of duty will be 54.8 cents/kg + 16% ad valorem. The suit-type jacket falls within textile category designation 435.
