Jones Blockware 3901 Gantz Road Grove City, Ohio 43123 RE: The tariff classification of a textile CD/DVD storage box from China Dear Ms. Jones: In your letter dated May 9, 2005, you requested a tariff classification ruling. The submitted sample is identified as a CD/DVD storage box (Sku #PCD01045). It measures approximately 5½”W x 9½”L x 6¼”H. The sides and top are covered with polyester quilted fabric framed by unsupported cellular plastic sheeting. You indicate that the padding is 100 percent polyester batting. The bottom of the item is covered with unsupported cellular plastic sheeting backed with a plain woven fabric reinforcement. The inside is covered with a polyester woven fabric. The box has a lid that is secured by a snap closure. The polyester fabric imparts the essential character to this item. The applicable subheading for the CD/DVD storage box will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up textile articles, other. The rate of duty will be 7 percent ad valorem. The sample will be returned as requested. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
