Leavens ABX Logistics, USA 41873 Ecorse Road, Suite 200 Romulus, MI 48111 RE: The tariff classification of two women’s pullovers from Nicaragua Dear Ms. Leavens: In your letter dated April 7, 2005 you requested a classification ruling on behalf of Clean Clothes, Inc., Ypsilanti, MI. Your first sample, style 1094, is a woman’s pullover constructed from 100% cotton knit fabric. The outer surface of the garment measures more than nine stitches per two centimeters in the direction in which the stitches were formed. The garment features two front panels that cross over one another to form a faux wrap effect. The garment also features sleeveless hemmed armholes and a hemmed bottom. Your second sample, style 1093, is a woman’s pullover constructed from 100% cotton knit fabric. The outer surface of the garment measures more than nine stitches per two centimeters in the direction in which the stitches were formed. The garment features two front panels that cross over one another to form a faux wrap effect. The garment also features long hemmed sleeves and a hemmed bottom. The applicable subheading for styles 1094 and 1093 will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: women’s. The duty rate will be 16.5% ad valorem. Styles 1094 and 1093 fall within textile category designation 339.
