Box 45055 Los Angeles, CA 90045 RE: The tariff classification of floral packaging material from China Dear Ms. Araki: In your letter dated July 26, 2005, you requested a tariff classification ruling on behalf of your client, Westland Floral Company, of Carpinteria, California. The submitted samples are identified as materials that will be imported in sheets with a cross cut in the middle. This cross cut makes the articles made up in terms of Note 7 to Section XI, Harmonized Tariff Schedule of the United States (HTS). You indicate that one of these will be placed in a clear floral sleeve and cut flowers will then be placed in the middle of those two layers for retail packaging presentation purposes. The composition of the items is: A) Non-woven – 100 percent polypropylene B) Organza – 100 percent polyamide C) Mesh – 100 percent polypropylene The applicable subheading for the floral packaging material will be 6307.90.9889, HTS, which provides for other made up textile articles, other. The rate of duty will be 7 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
