Dear Ms. Jones: In your letter dated March 8, 2005, you requested a tariff classification ruling. The merchandise to be imported consists of three organizer systems numbered PF5347-5348, PF5345-5346, and PF5343-5344. The organizers are made of MDF wood and are made to stand on the floor. They are designed for use in pantries, laundry rooms, garages, closets, or anywhere organization is required. All of the organizers measure approximately 83 ½” high and 17 ½” deep and have adjustable shelves. The organizers are to be fastened to a wall with brackets. You have submitted photos and engineering drawings of the organizers with your request. PF5343 is approximately 16” wide without crown molding, with a wild cherry finish. PF5344 is approximately 16” wide without crown molding, with a maple finish. PF5345 is approximately 25” wide without crown molding, with a wild cherry finish. PF5346 is approximately 25” wide without crown molding, with a maple finish. PF5347 is approximately 25” wide without crown molding, with a wild cherry finish and two drawers. PF5348 is approximately 25” wide without crown molding, with a maple finish and two drawers. The applicable subheading for the organizer systems will be 9403.60.8080, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other furniture and parts thereof: Other wooden furniture: Other, Other.” The rate of duty will be Free. Articles classified in subheading 9403.60.8080, HTS, from China are not presently subject to visa or quota restraints, and no special documents are required. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
