Hubbard JCPenney Purchasing Corporation 6501 Legacy Drive Plano, TX 75024-3698 RE: The tariff classification of men’s corduroy pants from Nicaragua. Dear Ms. Hubbard: In your letter dated March 11, 2005, you requested a tariff classification ruling. As requested, your sample will be returned. JCPenney Lot #505-Cord is a pair of men’s pants constructed from 100 percent cotton, woven corduroy fabric. The pants have a tunnel elastic waistband with an outside drawstring; a fly front opening with a single button closure; side seam pockets; and hemmed legs. Although you refer to Lot #505-Cord as sleep pants, garments of this fabric and style are considered to be multi-use garments. The presence of the button on the fly provides sufficient closure for wear in a variety of situations in and around the home. As such, they are not classified in heading 6107, which is limited to garments designed for wear only to bed for sleeping. The applicable subheading for JCPenney Lot #505-Cord will be 6203.42.4005, Harmonized Tariff Schedule of the United States (HTS), which provides for men’s or boys’… trousers, bib and brace overalls, breeches and shorts: of cotton: other: other: trousers and breeches: men’s: corduroy. The duty rate is 16.6 percent ad valorem. JCPenney Lot #505-Cord falls within textile category designation 347.
