NY L82435 March 1, 2005 CLA-2-61:RR:NC:TA:359 L82435 CATEGORY: Classification TARIFF NO.: 6110.30.3055 Ms. Krisanne Stecklair Mothers Work, Inc. 456 North Fifth Street Philadelphia, PA 19123 RE: The tariff classification of a woman’s knit garment from China Dear Ms Stecklair: In your letter dated February 4, 2005, you requested a tariff classification ruling. Your sample is being returned as requested. The submitted sample, style number 18093, is a woman’s 70% rayon, 30% nylon, knit, rectangular shawl-like garment with long sleeves. The front of the garment features a full front opening and extends well below the knees. The back reaches to the waist. The garment may be worn with the front extensions thrown over each shoulder. The outer surface of the garment measures more than 9 stitches per 2 centimeters in the horizontal direction. The sleeves have rib knit cuffs. The bottom front is ribbed with a fringed finish. The applicable subheading for the garment will be 6110.30.3055, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters…and similar articles, knitted: of man-made fibers: other…other: women’s. The rate of duty will be 32% ad valorem. The garment falls within textile category designation 639.
