Box 1199 Williston, VT 05495 RE: The tariff classification of a tufted rug from China. Dear Ms. Marcoux: In your letter dated December 21, 2004, received by this office on January 10, 2005 you requested a tariff classification ruling. You be importing a “Sunflower Rug #28030” and “Sunflower Runner #28032”. A sample swatch the rug was submitted with your request. The face of the rug is made from acrylic yarns. The yarns are tufted into a base fabric. The back of the rug is coated with latex. It will measure 16 x 24 inches. The runner will be made in the same manner as the rug. It will measure 20 x 60 inches . The applicable subheading for the rug and runner will be 5703.30.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for carpets and other textile floor coverings, tufted, whether or not made up: of other man-made textile materials…other: measuring not more than 5.25m2 in area. The duty rate will be 6 percent ad valorem. The rug and runner fall within textile category designation 665. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
