Dear Mr. LaJeunesse : In your letter, which was received by this office on Jan 6, 2005, you requested a tariff classification ruling on behalf of California Manufacturing. As requested, your sample will be returned. Style 44913 is a pair of men’s sleep pants constructed from 100 percent cotton, finely knit jersey fabric. The garment has a tunnel elastic waistband, an unsecured fly with no means of closure, and hemmed legs. The applicable subheading for Style 44913 will be 6107.91.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for men’s and boys’…nightshirts, pajamas ... and similar articles, knitted or crocheted: of cotton: other: sleepwear. The rate of duty will be 8.7 percent ad valorem. Style 44913 falls within textile category designation 351.
