P.O., Box 260 Chillicothe, MO 64601 RE: The tariff classification of a bucket organizer, sun visor, sun hat and tool belt from China. Dear Ms. McCabe: In your letter dated October 1, 2004 you requested a classification ruling. The samples will be returned to you as requested. Four samples were submitted with your request. Style TG556 is a Bucket organizer made of woven 100% polyester fabric with PVC backing. The tool organizer is designed to fix over the rim of a bucket and has pockets at the bottom for storage and portability of the tools. Style TG541 is a Sun Visor made of woven 100% cotton fabric. The sun visor has a 4” peak and no covering for the crown. Style TG540 is a Twist Sun Hat made of woven 100% cotton fabric. The sun hat has a 4” brim and a self-fabric adjustable chin strap. The hat has a zipper case that is specially designed for the hat. Style TG518 is a Tool Belt made of woven 100% polyester fabric with PVC backing. The tool belt has two net pockets and a webbed belt.  The applicable subheading for style TG556, Bucket organizer will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTS), which provides “in part, for other bags and containers, with outer surface of textile materials, other, other, other, of man-made fibers.” The duty rate will be 17.6 percent ad valorem. The textile category designation is 670. The applicable subheading for style TG541, Sun Visor will be 6505.90.2545, Harmonized Tariff Schedule of the United States (HTS), which provides for “Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric… Other: Of cotton, flax or both: Not knitted: Other...Visors, and other headgear of cotton which provides no covering for the crown of the head.” The duty rate will be 7.5% ad valorem. The textile category designation is 359. The applicable subheading for style TG540, Twist Sun Hat will be 6505.90.2060, Harmonized Tariff Schedule of the United States (HTS), which provides for "Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric, in the piece (but not in strips), whether or not lined or trimmed; hair-nets of any material, whether or not lined or trimmed: Other: Of cotton, flax or both: Not knitted: Certified hand-loomed and folklore products; and headwear of cotton...Other." The duty rate will be 7.5% ad valorem. The textile category designation is 359.  The applicable subheading for style TG518 will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other made up textile articles, Other.” The rate of duty will be 7% ad valorem. There are no quota or visa requirements on this merchandise. Styles TG541, TG540 and TG 556 are not currently subject to quota and visa requirements. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
