Box 90008 Los Angeles, CA 90009 RE: The tariff classification of aromatherapy packs and slippers from Thailand Dear Mr. Ramirez: In your letter dated August 9, 2004, on behalf of El Darr Enterprises, Henderson, NV, you requested a tariff classification ruling. Samples were submitted with your letter. The sample is a clear plastic package with a zipper closure containing four “Natural Herbal Therapy Packs.” All are composed of a fabric shell filled with a variety of aromatic plant parts. The Shoulder Pack is approximately 18 inches long and 11 inches wide, with one of the long sides curved to fit around the wearer’s neck when the pack is placed on the shoulders. The Back Belt is a rectangle approximately 20 inches long and 4-1/2 inches wide, with an 18-inch long Velcro strap attached to both ends. The Eye Cover is an eye mask measuring approximately 8 inches long and 4 inches wide, with an elastic strap attached to the back. The Mint Pack (described as a Mint Pillow on the product label) is a rectangle measuring 7 inches long and 4 inches wide. The applicable subheading for these products will be 1404.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for vegetable products not elsewhere specified or included…other. The rate of duty will be free. Your inquiry does not provide enough information for us to give a classification ruling on the slippers. Your request for a classification ruling should identify all the materials the slippers are made from. In particular, identify the fabric of the sole and the fabric of the upper. If a blend of fibers, provide a breakdown. When this information is available, you may wish to consider resubmission of your request. The samples of the Herbal Therapy Packs are being returned to you. The sample of the slippers will be retained with the National Import Specialist for thirty (30) days, pending receipt of the additional information noted above. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
