Liberati Morris Friedman & Co. 325 Chestnut Street, Ste. 415 Philadelphia, PA 19106 RE: The tariff classification of hardware from China and Taiwan. Dear Mr. Liberati: In your letter dated July 30, 2004, you requested a ruling on behalf of LTL Home Products on tariff classification. The samples you provided are mounting hardware for shelving. The items include aluminum and steel shelving brackets, aluminum shelving clips and plastic shelving clips. The Bingo Shelving bracket is a kit including a bracket and hollow wall mounting hardware. The Allure Signature series is a set of two shelf clamps, of plastic or of aluminum. Also included was a sample of the Glacier Silver Duck Clip, a mounting clip that resembles a duck’s bill. The applicable subheading for the plastic products will be 3925.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for builders’ ware of plastics, not elsewhere specified or included: other. The general rate of duty will be 5.3 percent ad valorem. The applicable subheading for the aluminum and steel products will be 8302.41.6080, Harmonized Tariff Schedule of the United States (HTS), which provides for base metal mountings, fittings, and similar articles, and parts thereof, suitable for buildings, other, of iron or steel, of aluminum or of zinc, other. The general rate of duty will be 3.9 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
