Box 370080 Milwaukee, WI 53237-0080 RE: The tariff classification of textile jewelry from India. Dear Mr. Gardenier: In your letter dated May 26, 2004 you requested a classification ruling. Your submitted sample is a necklace and earrings that are made of jute with decorative wooden beads. The necklace is tied with a knotted string. The string passes through a wooden bead that can be used to adjust the length of the necklace. Although the wooden beads are highly decorative the jute creates the form and structure of the necklace and the earrings and imparts the essential character of the jewelry. The item is precluded from classification as jewelry by Chapter 71 Note 3(g). Which excludes “goods of Section XI (textiles and textile articles”). The applicable subheading for the jewelry will be 6217.10.9550, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up clothing accessories; parts of garments or of clothing accessories, other than those in heading 6212: accessories: other: other, other. The duty rate will be 14.6% ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
