Dear Mr. Chawla: In your letter dated April 28, 2004, you requested a tariff classification ruling. The sample submitted with your request is a length of extruded mesh. You state that the mesh was made by extruding and then stretching. The size of the mesh is 8mm x 8 mm and the weight is from 7 grams per square meter to 15 grams per square meter. The netting will be imported on rolls with widths from 48 inches to 72 inches and in lengths of at least 1000 linear yards. The netting may be made from high density polyethylene, linear low density polyethylene, or polypropylene. The netting will be used for laminating carpet underpadding. The applicable subheading for the extruded, stretched mesh will be 3926.90.9880, Harmonized Tariff Schedule of the United States (HTS), which provides for other articles of plastics, other. The rate of duty will be 5.3 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
