Krueger DHL Danzas Air and Ocean 2660 20th Street Port Huron, MI 48060 RE: The tariff classification of a box spring cover from Turkey Dear Mr. Krueger: In your letter dated April 1, 2004, you requested a tariff classification ruling on behalf of Culp Home Fashions. The submitted sample is identified as a box spring cover. The cover consists of a top, which covers the top of a box spring, and four sides. The top (brown) is made of 100 percent spun bond polypropylene. The sides are a quilted fabric. The outer facing of the sides is jacquard woven of 61 percent cotton and 39 percent polyester. The inner facing of the sides is made of 100 percent non-woven polypropylene and the filling is 100 percent polyurethane. Only the outer facing of the side panel is woven. The rest is either spun bonded or non-woven. The applicable subheading for the box spring cover will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up textile articles, other. The general rate of duty will be seven percent ad valorem. Articles classifiable under subheading 6307.90.9889, HTS, which are products of Turkey are currently entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP, however, is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. To obtain current information on GSP, check our Web site at www.cbp.gov and search for the term "GSP." The sample will be returned as requested. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
