Dear Ms. Carlin: In your letter dated March 23, 2003, on behalf of N.I. Teijin Shoji (USA), which was a follow-up to your earlier inquiry of July 3, 2002, which was returned for more information, you requested a tariff classification ruling. The supplier is GTS International Company, Limited, Korea. The instant sample, which was submitted with your original inquiry, consists of a knit fabric composed of polyester man-made fibers which has been coated/laminated on one side with a compact polyurethane plastics material. You state in your correspondence, that this material has the following composition by weight: Wt. Of Textile: 85 g/yd (36%) Wt. Of PU: 153 g/yd (64%) Total Wt.: 238 g/yd It is presumed that this material will be imported as roll goods. The applicable subheading for the material will be 5903.20.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for textile fabrics impregnated, coated, covered or laminated, with plastics, with polyurethane, of man-made fibers, not over 70 percent by weight of rubber or plastics. The rate of duty will be 7.5 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
