Dear Mr. Tamamoto: In your letter dated January 27, 2004, on behalf of Nichimen American Inc., you requested a tariff classification ruling. The instant sample, which was identified as style # 10146, consists of an ornamental tassel (graduation tassel) composed of 100% rayon man-made fibers. The tassel measures about 12 inches in overall length, which includes a loop for hanging. You included additional representative samples of the tassel threads as well as the tassel cord, which differed from those on the finished sample only with respect to color. The applicable subheading for the tassel will be 5808.90.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for … tassels, pompons and similar articles, … of man-made fibers. The duty rate will be 3.9 percent ad valorem. This merchandise falls within textile category designation 229. Based upon international textile trade agreements, products of China are presently not subject to any kind of textile restraints. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
