Grand Rapids, Michigan 49504 RE: The tariff classification of a greeting card organizer, containing greeting cards and envelopes, from China Dear Mr. Morse: In your letter dated December 5, 2003, on behalf of your client, Meijer Distribution, you requested a tariff classification ruling for the referenced item. A sample was furnished, which will be returned, as requested. The sample, designated Item # 543568, UPC#:0-73168-05063-7, is a rigid paperboard box covered on all exterior surfaces with decoratively printed paper. There are no words printed on the exterior, giving its country of origin or indicating its intended use as a greeting card organizer. The box has an attached cover but no closure mechanism. It measures 24 cm x 18 cm x 11 cm. It contains six (6) paper or paperboard dividers, headed “Card Planner”, “Happy Birthday”, “Congratulations (Wedding, New Baby, etc.)”, “Get Well”, “Sympathy”, and “Friendship-Blank”. It also contains an assortment of greeting cards and envelopes, not yet “organized” by subject matter, and a small blank book, titled “Greeting Card Planner”, which is a “month-by-month guide to holidays, birthdays and special occasions.” As noted above, the sample is not legally marked to indicate its country of origin, in condition as presented. The applicable subheading for the described greeting card organizer, containing cards, envelopes and a blank “planner booklet” will be 4817.30.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for: Boxes,…of paper or paperboard, containing an assortment of paper stationery. The rate of duty will be 0.4 percent ad valorem. Beginning on January 1, 2004, the rate of duty will be Free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
