Style 78574D, is a woman’s pullover constructed from 56% silk, 12% cotton, 12% wool, 17% nylon, 3% lycra jersey knit fabric. The outer surface of the garment measures more than nine stitches per two centimeters in the horizontal direction. The garment features a round neckline, long sleeves with tubular ends and a tubular bottom. Style 78574C is a woman’s pullover constructed from 75% silk, 25% cashmere jersey knit fabric. The applicable subheading for the 78574D will be 6110.90.9090, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of other textile materials: other: other: other: women’s. The duty rate for 2003 will be six percent ad valorem. The duty rate for 2004 will be six percent ad valorem. The applicable subheading for the 78574C will be 6110.90.1060, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of other textile materials: containing 70 percent or more by weight of silk or silk waste: other: women’s. The duty rate for 2003 will be 1.4% ad valorem. The duty rate for 2004 will be 0.9% ad valorem. Style 78574D falls within textile category designation 838. Style 78574C falls within textile category designation 739. Based upon international textile trade agreements these products from China are not subject to quota and do not require visas. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
