The tariff classification of various textile items from China.

Dear Ms. Krupskas: In your letter dated Nov. 18, 2003, you requested a ruling on behalf of Horizon Fabrics on tariff classification. You submitted samples of five items. The samples will be returned as you requested. The first item is a cotton canvas handbag, CVB-1. It measures 5½” x 5” and has two handles of 1” webbed fabric. The applicable subheading for the handbag, CVB-1, will be 4202.22.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strap…with outer surface of textile materials, other, of vegetable fibers and not of pile or tufted construction, of cotton. The rate of duty will be 6.4 percent ad valorem. The rate of duty for such goods effective January 1, 2004, will be 6.3 percent ad valorem. The second item is a cotton canvas toiletry bag, CVB-2, measuring 5½” x 6”, with a drawstring closure. The applicable subheading for the toiletry bag of cotton denim will be 4202.92.1500, HTS, which provides for travel, sport and similar bags, of a sheeting of textile materials, with outer surface of sheeting of plastic or of textile materials, with outer surface of textile materials, of cotton. The rate of duty in 2003 will be 6.4 percent ad valorem. Effective January 1, 2004, the rate of duty will be 6.3 percent ad valorem. The third item is a miniature pillow measuring 2½” square, with a shell of woven nylon fabric. The next item is called a group of trims, WT4-13167 through 13171. They are identical other than color. They are made of woven fabric that is cut into continuous flower shapes joined petal to petal to form a strip ¾” wide. They are filled to create a puffed effect. They will be imported in lengths of at least 3’. They are considered assembled articles for tariff purposes. The last item is another group of ribbon trims, WT4-13162 through 13166; again, the only difference is color. They are composed of ¼” ribbon with a textile flower sewn on every 2½”; each flower has a diameter of approximately 7/8” so that most of it hangs over the edge of the fabric. In the center of each flower is an artificial gemstone. These items are also considered assembled articles for tariff purposes. The applicable subheading for the miniature pillow and the trims WT4-13167 through 13171and WT4-13162 through 13166 will be 6307.90.9889, HTS, which provides for other made up articles . . . Other. The rate of duty in 2003 and 2004 will be seven percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
