Julia Newport News, Inc. 711 Third Avenue New York, NY 10017 RE: The tariff classification of a tote bag from India. Dear Ms. Julia: In your letter dated October 29, 2003, you requested a classification ruling for a tote bag. The sample submitted is identified as style S04-05-101, “Lounge Chair Bag”. The item is a double handle, open top tote bag designed to contain personal effects and accessories on a daily basis. It is manufactured wholly of man-made fiber textile material with plastic shoulder straps. The bag features a mesh interior lining with no additional features. It measures approximately 13”(L) x 17”(W). Your sample is being returned as requested. The applicable subheading for the tote bag will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of textile materials, other, of man-made fibers, other. The duty rate will be 17.8 percent ad valorem. 4202.92.3031 falls within textile category designation 670. Based upon international textile trade agreements products of India are not currently subject to quota and the requirement of a visa. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
