Dear Mr. Gat: In your letter dated September 25, 2003, you requested a tariff classification ruling. Samples and illustrative literature were submitted with your letter. The samples were examined and disposed of. Item nos. OV-205563A and OV-205563B are dipping sets containing a bottle of flavored oil measuring 7 inches by 1-3/4 inches, two ceramic dishes, and a packet of seasoning tucked inside each of the dishes. The dishes are square-shaped, ceramic (non-porcelain) serving dishes measuring approximately 3 inches by 3 inches and 2 inches deep. Item no. OV-205563A contains a bottle of canola oil infused with dried orange slices, green onion flakes, and small carrot bits. It also contains a bag of 50 percent green onion and 50 percent carrot flakes, and a bag of 75 percent sesame seed and 25 percent coriander mix. Item no. OV-205563B contains a bottle of red chilis, onion flakes, and small carrot bits, in canola oil. Also a bag containing 50 percent rosemary and 50 percent chili flakes, and a bag of 50 percent onion and 50 percent chili flakes. The applicable tariff provision for the blend of green onion and carrot flakes contained in item no. OV-205563A, will be 0712.90.8580, HTS, which provides for dried vegetables, whole, cut, sliced, broken or in powder but not further prepared… mixture of vegetables…other. The rate of duty will be 8.3 percent ad valorem. The applicable tariff provision for the flavored oils, the sesame seed and coriander, the rosemary and chili flake, and the onion and chili flake seasoning blends, will be 2103.90.8000, HTS, which provides for mixed condiments and mixed seasonings… other…other…other. The rate of duty will be 6.4 percent ad valorem. The applicable subheading for the ceramic (non-porcelain) serving dishes will be 6912.00.4810, HTS, which provides for other ceramic tableware, kitchenware… other than of porcelain or china…other, suitable for food or drink contact. The rate of duty will be 9.8 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
