Walton Blvd. Bentonville, AR 72716-0410 RE: The tariff classification of key rings and stickers from China Dear Ms. Van de Vieren: In your letter dated September 19, 2003, you requested a tariff classification ruling. The samples you submitted are a set of 4 steel wire split-ring key rings (item number VGT9932) and a package of plastic stickers (VGT9941). Two of the key rings are attached to 2-inch long ballpoint pens decorated with fabric and feathers. The other two key rings are fastened to fabric-covered notebooks measuring approximately 2 inches high by 1.5 inches wide. The stickers are 3-dimensional, puffy, plastic stickers in the shape of various sized hearts. In our opinion, the key rings with pens and notebooks and the stickers are not designed to amuse, and are therefore not toys. The applicable subheading for the key rings will be 7326.20.0070, Harmonized Tariff Schedule of the United States (HTS), which provides for other articles of iron or steel, articles of iron or steel wire, other. The rate of duty will be 3.9 percent ad valorem. The applicable subheading for the plastic stickers will be 3926.40.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for other articles of plastics…statuettes and other ornamental articles. The rate of duty will be 5.3 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
