NY J87927 September 16, 2003 CLA-2-25:RR:NC:2:238 J87927 CATEGORY: Classification TARIFF NO.: 2501.00.0000 Mr. Paul Rowley Global Inflight Products 8918 NE 152nd Avenue Redmond, WA 98052 RE: The tariff classification of a disposable Salt & Pepper Shaker Set from China and Turkey Dear Mr. Rowley: In your letter dated August 11, 2003, you requested a tariff classification ruling. The submitted sample consists of a disposable salt and pepper shaker set for one-time use by aircraft passengers. The set is composed of two shakers, constructed from colorless, transparent, food-grade plastic, and a colored plastic stand, into which the (removable) shakers are fitted. The shakers measure 22 mm in diameter x 24 mm in height, and have turquoise-colored plastic lids. Removable pieces of adhesive plastic film cover the holes in the lids (one hole for the salt shaker and four holes for the pepper shaker). The salt shaker is filled with 1 cc (1 gram) of salt and the pepper shaker is filled with 1 cc (2 grams) of pepper. The stand measures 58 x 27 mm, and is identical in color to the plastic lids. A permanently attached cylindrical “handle,” measuring 32 mm in height, is located at the center of the stand, between the shakers. Pursuant to Rule 3(c) of the General Rules of Interpretation, HTS, the applicable subheading for the subject product will be 2501.00.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Salt (including table salt and denatured salt) and pure sodium chloride, whether or not in aqueous solution or containing added anticaking or free-flowing agents; sea weater.” The rate of duty will be free. This merchandise may be subject to the requirements of the Federal Food, Drug, and Cosmetic Act, which is administered by the U.S. Food and Drug Administration.
