Dear Mr. Kwok: In your letter dated June 14, 2003, you requested a ruling on tariff classification. The merchandise is a fragrance lamp or vase. It is made of glass and nickel-plated alloy. The item has a central decorative body of glass, sealed and containing water and flowers. The top of the item is a removable cap. Beneath the cylinder, there is a recess in the body that holds a candle or small oil burner. The lamp comes with an empty fragrance bottle and a tealight candle. Although the item is called a lamp, it is not intended to provide illumination. Any light that it may provide is secondary to its decorative effect. The applicable subheading for this product will be 8306.29.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for statuettes and other ornaments, of base metal, other. The general rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.).
