Studio Park 1200 Wilson Drive West Chester, PA 19380-4262 RE: The tariff classification of a cosmetic organizer from China. Dear Ms. Stecklair: In your letter dated March 14, 2003, you requested a classification ruling for a cosmetic organizer. The sample submitted is identified as item number H78557 “Cosmetic Beauty Organizer”. The item is a specially fitted case designed to contain various types of cosmetic accessories, such as lipsticks, brushes, pencils compacts, powders, etc. It is made up of a paperboard base wholly covered on the exterior surface with a 100% cotton printed fabric. The case measures approximately 15-½”(W) x 8”(H) x 8”(D). The case features a hinged lid with a tassel pull for opening and closing. Your sample is being returned as requested. The applicable subheading for item H78557 will be 4202.12.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcases, vanity cases and similar containers, with outer surface of textile materials, of vegetable fibers and not of pile or tufted construction, of cotton. The duty rate will be 6.4 percent ad valorem. HTS 4202.12.4000 falls within textile category designation 369. Based upon international textile trade agreements products of China are not currently subject to quota and the requirement of a visa. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
