Dear Ms. Price: In your letter dated February 27, 2003, you requested a tariff classification ruling. The sample submitted, Item #21881, identified in your ruling letter request as a Play N Pretty Mini Train Case Set and on its hangtag as a Play N Pretty Beauty Wear Hair Set, consists of 1 pink toe separator, 1 purple toe separator, 2 bottles of nail polish, 1 pink lipstick, 1 orange lipstick, 1 heart-shaped container with blue make-up, 1 flower-shaped container with orange make-up, 1 square container with pink make-up, 1 pink flower-shaped hair clip decorated with glitter, 1 yellow flower-shaped hair clip decorated with glitter, 1 flower shaped mirror, 3 hair ties with glitter (yellow, pink, and blue), and 1 package of body gems. These components are packaged in form-fitting indentations inside three inner pink sleeves that fit inside a pink train case. All of the components contribute to the imitative role-play activity of dressing-up like a grown-up, and are put up in a manner indicating their use as a toy for the amusement of children. The train case measures approximately 6-1/2 inches in height x 5-1/2 inches in width x 2 inches in depth. The case is made of rigid plastic with a hinged opening, latch closure and plastic carrying handle. It’s interior contains three pull-out drawers with three compartments to hold the components. The applicable subheading for the dress-up toy set of Item #21881 will be 9503.70.0000, HTS, which provides for “Other toys, put up in sets or outfits, and parts and accessories thereof.” The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
