Dear Mr. Ding: In your letter dated March 4, 2003 you requested a classification ruling. The subject merchandise are window treatments, tissue box covers and bronze replicas. Samples of the items were not submitted. Photos of the tissue box cover and bronze replica were included. The window treatments will consist of curtains and valances. You indicate that the curtains and valances will be made from a 50 percent cotton and 50 percent polyester fabric. For the purpose of this ruling it is assumed that the fabric is woven. The tissue box cover is made from 100 percent silk fabric with a polyester lining. It is rectangular in shape and stylized to encase the entire tissue box. There is a slit opening on the top portion of the cover, used to remove a tissue. The cover features a tassel at each end. The bronze replica is stylized to resemble an animal figure. You indicate that these items will be less than one foot in each dimension and weigh less than 10 kilograms each. The applicable subheading for the window treatments will be 6303.92.2010, Harmonized Tariff Schedule of the United States (HTS), which provides for curtains (including drapes) and interior blinds; curtain or bed valances: other: of synthetic fibers: other… window curtains (including drapes) and window valances. The duty rate will be 11.4 percent ad valorem. The applicable subheading for the tissue box covers will be 6304.99.6030, HTS, which provides for other furnishing articles, excluding those of heading 9404: other: not knitted or crocheted, of synthetic fibers… other: other… other: containing 85 percent or more by weight of silk or silk waste. The duty rate will be 3.5 percent ad valorem. The applicable subheading for the bronze replicas will be 8306.29.0000, HTS, which provides for statuettes and other ornaments, and parts thereof, of base metal, other. The duty rate will be free. The window treatments fall within textile category designation 666. Based upon international textile trade agreements products of China are not subject to quota or visa requirements. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
