NY J80540 February 26, 2003 CLA-2-90:RR:NC:N1:105 J80540 CATEGORY: Classification TARIFF NO.: 9026.20.4000 Mr. Richard Nakamoto Meiko America, Inc. 6412 S. 216th Street Kent, WA 98032 RE: The tariff classification of a Tire Pressure Monitoring Valve from Japan Dear Mr. Nakamoto: In your letter dated January 27, 2003, for Pacific Industries Air Controls Inc., you requested a tariff classification ruling. The sample and your information indicate that it will replace the ordinary air valve in an automobile tire. While the automobile is in operation, it will measure the pressure of the air in the tire and transmit that information via its short range transmitter to a receiver including a display inside the car (not part of your item) so that the driver will learn of changes in air pressure (primarily for safety). While it does function as a valve, its essential character comes from the elements that make it a pressure telemetry device. In accordance with Harmonized System General Explanatory Note IV to Chapter 90, measurement telemetry units are classified in the heading of the measurement device. We assume the measurement is performed “electrically” per Additional U.S. Note 2 to Chapter 90. The applicable subheading for your sample will be 9026.20.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for “electrical” instruments and appliances for measuring or checking pressure. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
