Ruling Text

NY I89548 December 23, 2002 CLA-2-87:RR:NC:MM:101 I89548 CATEGORY: Classification TARIFF NO.: 8708.99.8080 Mr. John F. Jäger Customs Compliance Manager Toyota Tsusho America, Inc. 702 Triport Road Georgetown, Kentucky 40324 RE: The tariff classification of Automotive Fuel Tubes from Japan Dear Mr. Jäger: In your letter dated November 22, 2002 you requested a tariff classification ruling. You submitted pictures of automotive Fuel Tubes that come in three different sizes, with a wall thickness of 0.7 mm, but different outside diameters. One tube has what appears to be a brass fitting that is attached to the fuel tube. The others have flared ends for connecting the fuel tubes together – but different diameters. All three tubes have what appears to be a plastic covering pressed or coated onto each tube. The tubes are made of non-alloy steel and are coated to deter corrosion. The applicable subheading for the Automotive Fuel Tubes will be 8708.99.8080, Harmonized Tariff Schedule of the United States (HTS), which provides for Parts and accessories of the motor vehicles of headings 8701 to 8705: Other parts and accessories: Other: Other: Other: Other…Other. The rate of duty will be 2.5% ad valorem. This rate of duty will remain unchanged in the year 2003. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Robert DeSoucey at 646-733-3008. Sincerely, Robert B. Swierupski Director, National Commodity Specialist Division
