Dear Ms. Placido: In your letter dated December 23, 2002, you requested a tariff classification ruling. The submitted items, Style #A106934, which you refer to as a wardrober set, consists of four garments; two pullovers, one skirt and one pair of pants. All four garments are constructed from 100% cotton knit fabric. Each garment will be classified separately. The garments of Style A106934 are described as follows: Pants – The garment features an elasticized waist, side seam pockets, embroidered boat designs at the bottom of both legs, and hemmed leg openings with side slits. Skirt – The garment features an elasticized waist, embroidered boat designs all around the bottom, a rear slit, and a hemmed bottom. 3. Striped Pullover – The garment features a scoop neckline, short sleeves, an all-over embroidered boat design, rhinestones, on the front panel, slits at both sides, and a hemmed bottom. The outer surface of the pullover measures more than 9 stitches per 2 centimeters in the horizontal direction. 4. Solid Pullover – The garment features a scoop neckline, short sleeves, embroidered boat designs at the chest area, rhinestones at the chest area, slits at both sides, and a hemmed bottom. The outer surface of the pullover measures more than 9 stitches per 2 centimeters in the horizontal direction. We are returning your samples as you requested. The applicable subheading for the Pants of Style A106934 will be 6104.62.2011, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ trousers, bib and brace overalls, breeches and shorts (other than swimwear) knitted or crocheted, trousers, bib and brace overalls, breeches and shorts, of cotton,women’s. The rate of duty will be 15.1% ad valorem. The Pants of Style A106934 fall within the textile category designation 348. Based upon international textile trade agreements, this category from Vietnam is not subject to visa requirements nor quota restraints. The applicable subheading for the Skirt of Style A106934 will be 6104.52.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ skirts and divided skirts, knitted or crocheted, of cotton, women’s. The rate of duty will be 8.4% ad valorem. The Skirt of Style A106934 falls within the textile category designation 342. Based upon international textile trade agreements, this category from Vietnam is not subject to visa requirements nor quota restraints. The applicable subheading for the Pullovers of Style A106934 will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for pullovers, knitted or crocheted, of cotton, women’s. The rate of duty will be 16.9% ad valorem. The Pullovers of Style A106934 fall within the textile category designation 339. Based upon international textile trade agreements, this category from Vietnam is not subject to visa requirements nor quota restraints.
