Dear Mr. Grego: In your letter dated November 7, 2002, you requested a tariff classification ruling. The candle is described as a spiral shaped wax candle that measures approximately 1.5”D x 4”H and has a wax composition of 60% palm oil wax and 40% paraffin wax. The applicable subheading for the spiral shaped wax candle will be 3406.00.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for candles, tapers and the like. The rate of duty is free. Candles from China may be subject to anti-dumping duties administered by the U.S. Department of Commerce, Import Administration.
