Industrial Drive (Caller #2101) Ripley, TN 38063 RE: The tariff classification of an air driven starter motor from Japan Dear Ms. Bogue: In your letter dated September 25, 2002 you requested a tariff classification ruling on behalf of Komatsu. The item in question is described as an air starter assembly, part number PB4988. Descriptive literature and technical drawings were submitted. Based on the information submitted the air starter assembly is air driven motor used to start an engine on a dump truck. The starter assembly uses pressurized air to create rotary motion. The applicable subheading for the air driven starter assembly will be 8412.39.0040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for unlimited rotary acting pneumatic power engines and motors. The rate of duty is free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
