Box 71 Ellicott Station Buffalo, N.Y. 14205-0071 RE: The tariff classification of pouches from China Dear Ms. Hua: In your letter dated October 1st, 2002 you requested a tariff classification ruling. The first sample submitted, identified as the “Shoulder Safe”, is a holder designed to be worn over the shoulder and under the arm similar to a shoulder holster. It measures 7” x 6.5” x 1”. It is designed to contain passports, documents, and money. The second sample submitted, identified as the “Tummy Safe”, is a belt pouch designed to be worn under a garment and around the waist. It has one main zippered compartment that is divided into two sections. The “Tummy Safe” is designed to contain passports and currency. The third sample submitted, identified as the “Neck Passport Case”, measures 9” x 5.5”. It has a cord neck strap with a cord lock. The pouch has a top zipper closure. The interior is divided into two sections and the rear wall is fitted with six vertical credit card slots. It is designed to contain items such as passports and travel documents as well as small articles of a kind normally carried in a handbag. The fourth sample submitted, identified as the “Neck Wallet”, measures 8” x 5.5”. It has a cord neck strap with a cord lock. The pouch has a flap with a hook and loop closure. The interior is divided into two sections and the rear wall is fitted with six vertical credit card slots. The rear exterior has one open pocket. It is designed to contain items such as passports and travel documents as well as small articles of a kind normally carried in a handbag. Each item is wholly made-up of man-made textile materials. The applicable subheading for all four items will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcases, holsters, and similar containers with outer surface of textile materials, other, other, other of man-made fibers. The rate of duty will be 18.1 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
