NY I86170 October 8, 2002 CLA-2:RR:NC:2:226 NY I86170 CATEGORY: Classification TARIFF NO.: 7010.90.50 Mr. Erik Smithweiss Grunfeld, Desiderio, Lebowitz, Silverman & Klestadt 245 Park Ave. 33rd Floor New York, NY 10167-3397 RE: The tariff classification of “4 piece glass apple canister set” Dear Mr. Smithweiss: In your letter received September 9, 2002 you requested a tariff classification ruling, on behalf of Alco Industries, regarding the “4 piece glass apple canister set.” A sample of the merchandise was submitted with your ruling request. The product consists of four glass articles (with varying volumes and heights); each article has a wire bail and trigger closure mechanism, and a rubber gasket that allows a hermetic seal to be formed. These articles are packed together for retail sale as a set. The applicable subheading for the glass articles with bail and trigger closures will be 7010.90.50, HTS, which provides for glass preserving jars...other...other. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
