NY I85592 September 10, 2002 CLA-2-62:RR:NC:N3:360 I85592 CATEGORY: Classification TARIFF NO.: 6211.43.0060; 6211.43.0078 Ms. Jennifer Soto Exel Global Logistics Inc. 10205 N.W. 19th Street Suite 101 Miami, FL 33178 RE: The tariff classification of women's blouses and jackets from Guatemala Dear Ms. Soto: In your letter dated August 22, 2002, you requested a tariff classification ruling on behalf of Central American Imports. The samples submitted with your request will be returned to you under separate cover. All of the submitted styles are constructed from 100 percent polyester woven fabric. Style 5082B is a woman’s sleeveless pullover blouse that features a shaped front neckline, a straight hemmed bottom and measures 1-½ inches at the shoulder seams. Style P1026BC is a woman’s sleeveless blouse that features a round neckline, two front vents, a full back opening secured by six buttons and measures 2-½ inches at the shoulder seams. The neckline and arm openings have contrasting colored piping. Style 2073TW is a woman’s jacket that features long sleeves, a collar and lapels, shoulder pads and a full front opening secured by three buttons. The jacket extends from the shoulders to the knee. Style 94185N is a woman’s jacket that features short sleeves, a collar and lapels, shoulder pads and a full front opening secured by a metal clasp. The jacket extends from the shoulders to the knee. The applicable subheading for styles 5082B and P1026BC will be 6211.43.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of man-made fibers: blouses, shirts and shirt-blouses, sleeveless tank styles and similar upper body garments excluded from heading 6206. The rate of duty will be 16.2 percent ad valorem. The applicable subheading for styles 2073TW and 94185N will be 6211.43.0078, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of man-made fibers: jackets and jacket-type garments excluded from heading 6202. The rate of duty will be 16.2 percent ad valorem. The blouses fall within textile category designation 641 and the jackets fall within textile category designation 635. Based upon international textile trade agreements products of Guatemala are currently not subject to quota restraints or a visa requirement. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
